(1) According to sub-section (4) of Section 20 of the Act, after the promotion list is published, for the purpose of promotion complaint, the candidate who is recommended for promotion shall be placed on the waiting list without promotion appointment for thirty-five days from the date of publication of the list. If there is no appeal against the above promotion recommendation, the appointment should be made in such a way that the seniority of the promoted category is maintained from the thirty-sixth day from the date of publication of the list (the day after the expiry of the appeal deadline).
(1A) If a complaint is filed against the recommendation for promotion based on seniority and performance evaluation as per sub-rule (1), until such complaint is resolved, the candidates recommended for promotion based on performance evaluation will also be kept on the waiting list without being promoted.
(1b) In the event that the promotion recommendation made through seniority and performance evaluation is amended and the name removed from that recommendation is included in the promotion through performance evaluation, even if no complaint is received according to sub-rule (1), the recommendation shall be maintained in the appropriate order of merit.
(2) Section 24 of the Act on promotion recommendation. If there is a complaint according to the following, the seniority date should be fixed and the appointment should be given:-
(a) Section 24 of the Act. If it is decided to revise the promotion recommendation according to sub-section (2), from the date of publication of the revised list accordingly, (b) from the thirty-sixth day from the date of publication of the first promotion notice if the complaint is dismissed or if the previous promotion notice is upheld, and
(c) If the promotion is revoked after a case is filed in the court regarding any promotion, and the promotion decision is made again by the promotion committee, from the date of the last decision by the promotion committee.
(3) Section 20A of the Act within thirty-five days from the date of publication of the promotion list according to sub-rule (1). In case of promotion, the promotion committee may not include the list of such employees in the promotion recommendation.
